These terms and conditions apply to all websites that are owned, operated, and maintained by or for Wamoo Ltd., a Ugandan corporation ("we", "us", or "our"), including www.wamoo.co and other websites or mobile applications on which these terms and conditions are linked (collectively, “Site(s)”) as well as your use of the services we provide and other transactions and engagements you may have with us (collectively, “Services”). These Terms and Conditions, along with our Privacy Policy and any additional terms or rules specific to certain features, govern your use of Wamoo’s Site and Services. By accessing or using Wamoo, you confirm that you have read, understood, and agree to these Terms.

1. General Provisions

Wamoo is intended for citizens and legal residents of East African Community countries who are at least 18 years old. Wamoo is currently in closed beta testing. By agreeing to these terms, you consent to participating in the testing process, including sharing personal and identifying information for testing and feedback purposes. During this phase, some platform functionality may be unavailable or work differently than the final version. Deposits made during beta testing will be held in accounts managed by the directors of Wamoo Innovations SMC Limited until the platform is fully operational with partner banks. Wamoo reserves the right to modify these Terms. Material changes will be communicated via email or posted on the Site at least 14 days before taking effect. Continued use after such changes constitutes acceptance.

2. Password and Account Security

To use certain features, you must create an account by providing accurate, current, and complete registration information. You are responsible for maintaining the confidentiality of your password and all activities under your account. Notify us immediately at hello@wamoo.co if you suspect unauthorized access to your account.

3. Depository Accounts

a. Relationship with Partner Banks
Wamoo is a technology platform, not a bank. Depository accounts will eventually be established with partner banks, but during beta testing, all deposits are managed by the directors of Wamoo Innovations SMC Limited.

b. Depository Agreement
By opening a depository account, you agree to the terms outlined in the partner bank’s Depository Agreement. Ensure you review this agreement carefully for details on account responsibilities and applicable insurance.

4. Consent for Electronic Delivery of Documents

By using Wamoo, you consent to receive communications electronically. You may request paper copies by contacting hello@wamoo.co, though a service fee may apply.

5. User Guidelines

You agree to use Wamoo responsibly and in compliance with all applicable laws. Prohibited actions include providing false information, engaging in fraudulent activity, or attempting to disrupt the platform.

6. User Data

Wamoo collects, processes, and stores data in accordance with its Privacy Policy. By participating in the beta testing, you consent to Wamoo using your data, including personal and identifying information, for testing purposes and platform improvements. Users are responsible for ensuring the accuracy of the data they provide.

7. Termination

Wamoo may suspend or terminate your account at its sole discretion for violations of these Terms or for other reasons, including suspicious activity. Upon termination, all associated data may be deleted.

8. Tickets and Draws

Earning Tickets
For every UGX 5,000 in your average monthly balance, you earn 1 ticket.
Monthly Jackpot Draw: Held on the 1st of each month with a prize valued above UGX 3,000,000.
Deposits made in the first 10 days of the month earn a 10% ticket boost, while frequent deposits earn bonus tickets.

9. Referral Program

Wamoo may offer a referral program. By participating, you agree to refer only individuals with whom you have a personal relationship and abide by program rules.

10. Fees

Deposit Fees: UGX 0 (no charge for deposits).
Withdrawal Fees:

UGX 5,000 for withdrawals under UGX 2,000,000.
5% of the withdrawal amount for withdrawals above UGX 2,000,000.

11. Disclaimer of Warranties

Wamoo’s platform is provided "AS IS" without warranties of any kind, and Wamoo disclaims all implied warranties, including those of merchantability and fitness for a particular purpose.

12. Our Intellectual Property

All content on Wamoo’s platform, including logos, designs, and trademarks, is Wamoo’s property or licensed to us. Unauthorized use is strictly prohibited.

13. Limitation of Liability

Wamoo is not liable for indirect, incidental, or consequential damages arising from platform use. Total liability is limited to USD 100.

14. Dispute Resolution

All disputes shall be resolved via binding arbitration in Kampala, Uganda, under the Uganda Arbitration and Conciliation Act.

15. Governing Law

These Terms are governed by the laws of Uganda, and any legal proceedings must be initiated in Kampala.

16. Indemnity

You agree to indemnify and hold Wamoo harmless from any claims arising from your use of the platform or violation of these Terms.

17. Links

The platform may contain links to third-party sites. Wamoo is not responsible for the content or policies of these external sites.

18. Force Majeure

Wamoo is not liable for delays or failures caused by events beyond our control, including natural disasters or network outages.

19. Feedback

By submitting feedback, you grant Wamoo the unrestricted right to use it for any purpose without compensation.

20. Miscellaneous
